When Ownership Comes With a Fight

A Condo Dispute Puts Your Property on the Line

You own real property — but your condominium is still governed by a declaration, bylaws, and a board of managers with real authority. When you're hit with a special assessment you don't understand, a common-charge lien, or a board decision that feels unfair, the stakes are both financial and personal.

Boards face the other side of it: an owner who won't pay common charges, ignores the rules, or damages the building puts every other owner at risk. Either way, condo disputes turn on the governing documents and on how New York courts review a board's decisions.

Common Questions

Condo Dispute FAQs

What are common condominium disputes?

Condo disputes often involve unpaid common charges and assessments, common-charge liens, water leaks and repair responsibility between units and common elements, alteration approvals, enforcement of the declaration and bylaws, nuisance and house-rule issues, and disagreements over board authority and governance. They can arise between a unit owner and the board, or between owners.

Can I sue my condo board?

In some situations, yes. As with co-ops, New York courts generally review condo board decisions under the business judgment rule, giving good-faith decisions made within the board's authority significant deference. Claims are more likely to succeed where a board acted in bad faith, outside the scope of its authority, or in a discriminatory or unequal way. An attorney can assess whether your situation fits one of those exceptions.

What happens if I don't pay my common charges?

Unpaid common charges can lead to serious consequences. Under New York law, a condominium can generally place a lien on the unit for unpaid common charges and, in some circumstances, move to enforce that lien. If you're facing a common-charge dispute or lien — as an owner or a board — it's important to understand your rights and options before the matter escalates.

Who is responsible for water damage between condo units?

Responsibility usually turns on the declaration and bylaws, which define what is part of a unit versus a common element, and on the cause of the damage. Because these documents vary from building to building, the answer isn't automatic. An attorney can review the governing documents and the facts to help determine who bears responsibility.

How much does a condo dispute lawyer cost?

Fees depend on the nature and complexity of the dispute. We'll discuss fee structure directly with you so you understand the arrangement before moving forward. Contact our office to talk through your situation and the costs involved.
