What are common condominium disputes?
Condo disputes often involve unpaid common charges and assessments, common-charge liens, water leaks and repair responsibility between units and common elements, alteration approvals, enforcement of the declaration and bylaws, nuisance and house-rule issues, and disagreements over board authority and governance. They can arise between a unit owner and the board, or between owners.
Can I sue my condo board?
In some situations, yes. As with co-ops, New York courts generally review condo board decisions under the business judgment rule, giving good-faith decisions made within the board's authority significant deference. Claims are more likely to succeed where a board acted in bad faith, outside the scope of its authority, or in a discriminatory or unequal way. An attorney can assess whether your situation fits one of those exceptions.
What happens if I don't pay my common charges?
Unpaid common charges can lead to serious consequences. Under New York law, a condominium can generally place a lien on the unit for unpaid common charges and, in some circumstances, move to enforce that lien.
