Pleadings and Motions

A lawsuit formally begins with the filing of the complaint, which sets forth the allegations that the plaintiff makes against the defendant. The plaintiff must file this document in the correct court and serve it properly on the defendant. Once the defendant is served, they will have 20 or 30 days to respond, depending on how they were served.

A response may include:

  • An answer that addresses each claim made in the complaint
  • Affirmative defenses, those for which the defendant must introduce evidence
  • A motion to dismiss the lawsuit

You should not take a motion to dismiss lightly, because either way it could end the lawsuit very early in the process and prevent further action. Discovery

The party that succeeds at trial can take steps to enforce the Manhattan court’s judgment. In certain circumstances, the losing party can appeal the trial court’s decision to a higher court. But there are only limited grounds for appeal; it is not simply a second chance to try the case.
